Simple Rules: The Muscle & Fitness Model Search Online is a three (3) month online contest where each of the six (6) winners (two winners per month) will qualify for a spot in the 16-men finals of the Muscle & Fitness Model Search in Las Vegas on September 29, 2012 (“Finals”). The overall winner of the Muscle & Fitness Model Search in Las Vegas receives an exclusive photo shoot with Muscle & Fitness Magazine with an opportunity to appear on a Muscle & Fitness Magazine cover. No talent required, open to all male contestants who are 18 years of age or older. Models that have appeared in previous covers of Muscle & Fitness Magazine are not allowed to participate. Pictures submitted must cover all personal areas. Applications will be accepted on an ongoing basis. The online voting period ends on the 15th of each month, after which the 10 highest vote getters will be brought to the selection board. The selection board will then choose the two monthly winners. Winners will be announced on the 16th of each month. Winners will be notified by e-mail or telephone. All entrants must read the official rules including the disclaimer before submitting your application and uploading your pictures. All Winners attendance will be required in Las Vegas, Nevada on September 28 & 29, 2012. Each contestant is responsible for his own time, travel, and lodging to the Finals.
Official Rules: The Contest is offered only in the United States to legal residents of the 50 United States and the District of Columbia. Open to males, who are 18 years of age or older, as of May 1, 2012. Models that have appeared in previous covers of Muscle & Fitness Magazine are not allowed to participate. Hosting Company: Weider Publications, LLC (herein referred to as “Hosting Company”) is the event coordinator of the Muscle & Fitness Model Search Online Contest (herein referred to as the “Contest”).
How to Enter: Beginning at 12:01 ET on May 1, 2012, log on to www.muscleandfitness.com for the official online entry form. You must complete all information requested, including but not limited to, your legal name, full address (including apartment number), city, state/provence, Zip Code, daytime, home or cell telephone numbers, e-mail address at which you can be reached, date of birth, and all other information requested on the form.
How to Submit Photos: Submissions must be received by the 21st of each month prior to the month contest. Entries for the month of June must be received from May 1, 2012 12:01 ET to May 21, 2012 11:59 ET to participate; Entries for the month of July must be received from June 1, 2012 12:01 ET to June 21, 2012 11:59 ET to participate; Entries for the month of August must be received from July 1, 2012 12:01 ET to July 21, 2012 11:59 ET to participate. Candidates will be able to e-mail six (6) recent photographs, (herein referred to as Images), in JPEG format using the instructions provided. Images must only include contestant. All images submitted must be sized at 297 width x 443 height and with a resolution of 72 pixels per square inch. Once all required information is received, and you are selected as a candidate to compete in the Contest, your Images will be posted online. The Hosting Company reserves the right to contact any contestant who has entered the Contest to request resubmission of one or more of the Images and/or to request that the Contestant submit additional images. While Contestants may have assistance in entering data and uploading the images, each Contestant must otherwise complete the entry form by himself. Any entries submitted by anyone other than the person appearing in the Images (including but not limited to entries submitted by modeling agencies) will be rejected. As set forth in greater detail herein, submission of Images and entry in the Contest constitutes consent to use the Images on said website, www.muscleandfitness.com and/or associated or otherwise affiliated websites. Except as otherwise permitted herein, only one entry per person will be accepted each month; all subsequent entries will be disregarded. No enhanced or altered photographs or photographs containing more than one person will be eligible. False, deceptive or incomplete entries or other information provided by Contestants throughout the Contest (including but not limited to responses to questionnaires) shall render the entry ineligible.
Re-Entry:: Contestants (winners excluded) are allowed to re-enter the Muscle & Fitness Model Search Online for each of the remaining months. In order to reenter, contestants must re-register and re-submit images.
Eligibility: All Contestants must be male, and at least 18 years of age or older on the date that the Images were taken. Employees of American Media, Inc., Weider Publications, LLC, their affiliates, subsidiaries, advertising or promotion agencies, and its managers, employees and agents, and members of the immediate family of such individuals (including spouses, parents, siblings, children and their respective spouses) and persons living in the same household with any such individuals are ineligible. Models that have appeared in previous covers of Muscle & Fitness Magazine are not allowed to participate. No IFBB Professional League athletes or any other Professional athletes are allowed to participate. Contestants will also be required to represent and warrant that they have sufficient rights to the Images, and all other materials submitted in connection with this Contest to grant the Hosting Company the rights granted hereunder. If the Images are modeling shots, photographs taken by a professional photographer, or anything other than personal snapshots in which the Contestant holds or rights, or if they include any copyright notice, Contestants will be required to demonstrate that the copyright holder(s) has granted him the right to allow the Hosting Company to reproduce and publish the photographs, by agreeing to and checking the box upon submission that such right has been granted. Contestant also agrees to have the signed Copyright Release readily available and provide it should Hosting Company request it. Contestants are responsible for any financial reimbursement to the original copyright holder for the rights to publish the Images as provided herein; the Hosting Company will not be responsible for any such payment, and will not be held under any obligation to publish a photo credit to the original copyright holder for the publication of an image. Contestants shall agree to hold the Hosting Company harmless and to indemnify the Hosting Company from any and all liabilities, loss, claims, or causes of actions, including reasonable attorneys’ fees and expenses that may be incurred by the Hosting Company, arising out of or relating to my breach of any representation or warranty, or any other violation of these Official Rules. Failure to comply with these Official Rules will result in ineligibility of Contestant. All federal, state/provincial and local laws and regulations of the United States apply. Void where prohibited or restricted by law. Contestants agree to be bound by these Official Rules. Failure to comply with these Official Rules will result in ineligibility of Contestant.
Judging Criteria: Our selection board will use the following criteria to choose the winners: (a) muscularity and body condition (50%), (b) symmetry (25%), and overall appearance (25%).
Selection / Winner: Through the online process, visitors to www.muscleandfitness.com will be able to cast their vote for each of the three (3) months of the contest through the 15th of the month, beginning in June 2012. The selection of the final Winner(s) will be determined by the selection board of the Hosting Company, whose decisions shall be final, and shall be based on the judging criteria posted above.
Prize / Value: Muscle & Fitness Model Search Online monthly winners qualify for a spot in the 16-men finals of the Muscle & Fitness Model Search in Las Vegas on September 28 & 29. Notification / Terms: Winner will be notified by email or telephone. Entry constitutes permission to use Contestant’s name on www.muscleandfitness.com publications, and/or on the Website, or an affiliated or associated website, and their consent to use his name, photograph, comments and/or voice/video recordings and likenesses for advertising or publicity purposes, in any and all media – including but not limited to publications, online display, television, cable, video, DVD and/or film productions, wireless applications and other media channels and applications, and for advertising, promotions, other Contests sponsored by one or all of the Hosting company and other commercial purposes (whether by the Hosting Company or any third party) – without additional compensation or permission, except where prohibited by law.
Contestants consent to a background check that may be performed, at the sole discretion of the Hosting Company, to verify information provided by Contestants and compliance with these Official Rules, or for other reasons related to the Contest. This Contest shall be governed and construed by Florida law, and the exclusive venue for all controversies will be in state or federal court in Palm Beach County, Florida. The Hosting Company reserves the right to crop or otherwise alter images. Contestant waives (or shall ensure that copyright holder waives if Contestant is not copyright holder) in favor of Hosting Company and anyone authorized by them, any and all moral rights that Contestant (or copyright holder) may have in any image. If any Contestant does not return any document within the time frame indicated on the document, or cannot be contacted, Contestant will be disqualified.
Disclaimer and Release of Liability: The Hosting Company and all its affiliates are not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to participants’ or any other person’, computer relating to or resulting from participation in this Contest; inability to access the entry website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. Proof of entering information at website is not considered proof of delivery or receipt. All dates set forth in these Official Rules are approximate. The Hosting Company reserves the right to extend any deadlines. All entries and any other material submitted (including but not limited to image) become the sole property of the Hosting Company. False and or deceptive entries or accounts shall render entry ineligible. All decisions of the Hosting Company shall be final and conclusive on all matters relating to the Contest.
General: The Contest is governed by the laws of the State of Florida. By entering, entrants/winners agree: (a) to release the Sponsor and its agents from all liability, loss or damage arising out of or relating to the participation of entrants/winners in the Contest, including with respect to their acceptance and use/misuse of the prizes; (b) to be bound by these Official Rules; (c) that the decision of the Sponsor is final and binding on all matters relating to the Contest; and (d) to the use of their names, personal information and likenesses for advertising and promotional purposes in all media worldwide (including the internet) without additional compensation, except in Tennessee and where otherwise prohibited by law. All applicable federal, state and local laws and regulations apply. Winners are responsible for all federal, state and local taxes. All winners will be issued an IRS 1099 tax form for the actual value of their prize. No responsibilities are accepted for any additional expenses, omissions, delays, re-routing or acts of any government or authority. All winners must submit an
Affidavit of Eligibility / Release of Liability / Prize Acceptance Form immediately upon being chosen. If any prize or affidavit or release is returned to Sponsor as undeliverable or if Sponsor does not receive a response from any winner within seven (7) business days of attempted notification, such winner may be disqualified and such prize will be awarded to an alternate winner. Noncompliance with these Official Rules shall result in disqualification and award of prizes to an alternate winner. By accepting prizes, winners consent that Sponsor may use the winner’s name, image (including but not limited to photographs, videos and other likenesses), biographical information and statements concerning the Contest, without compensation in connection with advertising, promotion and merchandising, and winners irrevocably grant the right to edit or modify and to publish and copyright the foregoing. Winners must also make themselves available to travel at Sponsor’s expense for promotional purposes. By accepting prizes, winners agree to hold Sponsor and its managers, employees, agents, licensees, successors and assigns, harmless from and against any and all claims and liability arising out of any and all prizes. Winners assume all liability for any injury or damage caused, or claimed to be caused, by participating in the Contest. By participating in the Contest, entrants agree to abide by and be bound by these Official Rules, and understand that the Contest results are final in all respects. By participating in the Contest, entrants agree to hold Sponsor and its managers, employees, agents, licensees, successors and assigns, harmless from and against any and all claims and liability arising out of such participation. Entrant is responsible for all online charges incurred by entrant’s internet service provider. Sponsor does not make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any prize, including, without limitation, quality, merchantability and fitness for a particular purpose.
All Contestants and Winners release the Hosting Company and their parent companies, affiliates, subsidiaries, wholesalers, retailers, officers, directors, agents, employees and all other associated with the development and execution of this Contest from any and all liability with respect to, or in any way arising from this Contest, publication or use of their images, including liability for personal injury, death, damages, or monetary loss. The Hosting Company reserve the right to terminate, withdraw or amend the Contest for any reason. Contestants consent to the Hosting Company’s collection, use and disclosure to third parties of Contestants’ personal information for the purpose of administering this Contest and as otherwise set out in these Official Rules.
